LONG ISLAND GYMS TO FILE LAWSUIT AGAINST NY IN ORDER TO REOPEN DURING PHASE IV

The group of New York gym owners filing a class-action lawsuit to be allowed to reopen met again last night. It was productive. All we are asking for is the opportunity to display that we can open safely and efficiently, not just for our members, but for our community. The goal is simple and well within reason.

Interestingly enough Connecticut gyms were part of that state’s Phase 2 reopening and have been open since June 17th. When interviewed by the Hartford Courant, Erik Castiglione, the owner of Viking Athletics in West Hartford said, “The nature of CrossFit facilities — wide-open spaces, typically referred to as “boxes,” with equipment stored around the edge of the gym — is an advantage. The way our membership works is we don’t just allow people to walk in off the street and start working out. A lot of the movements that we do are technical in nature because we’re using barbells.”

Of course, that’s absolutely correct.

This is purely educated guessing and speculation on my part. It seems the local officials are good to go as far as gym openings are concerned. The issue seems to be that local officials don’t want to make a decision independent of the governor’s decision. One would think if this were the case then enforcing the shutdown wouldn’t be a “priority” but several gyms on Long Island were shutdown for having outdoor classes or opening up their gyms ahead of the official go-ahead, even though every single precaution was taken to keep everybody safe.

Make no mistake. There are no officials looking to arrest gym owners or shut down gyms but if somebody calls action must be taken.

Who would do that?

Who would complain about people working out safely or gym owners earning a living?

That’s what I thought but speaking with the other gym owners and my law enforcement contacts this I can tell you and it’s not “guessing or speculation”: People are calling. Often.

As for Governor Cuomo, he’s met with two different lobbyists from our industry and has spoken with county executives and he shot everybody down. I’m not sure why but the governor really doesn’t seem to care what happens with gyms. He has been presented with science demonstrating how we can safely open. He has presented no science or evidence to back his decision not to allow us to open. It makes no sense.

Not making sense seems to be THE common theme lately.
